Photography Services Agreement Form

1. Services Provided

Media by Mary agrees to provide the following photography services:

  • Sports photography, individual portrait, duo sessions, group photoshoots
  • Date of Service (agreed between both parties)
  • Time of Service (agreed between both parties)
  • Location of service is left to my discretion or agreeance of both parties


2. Payment and Fees

Client  agrees to pay a non-refundable initial fee to reserve photographers time and ensures no advertisement of said reserved time.

  • A non-refundable deposit of 50% of Session Amount is due upon signing this Agreement.
  • The remaining 50% is due at an agreed upon date (or interval).


3. Cancellation and Rescheduling

If client wishes to cancel or reschedule the services, the following terms apply:

  • Cancellations made more than 7 days before the event will result in a full refund (not including non-refundable deposit)
  • Cancellations made within 7 days of the event will result in a forfeiture of the deposit.
  • Rescheduling requests will be accommodated based on photographer's availability.


4. Copyright and Ownership

The photographer retains the copyright to all images created during the session. Client is granted a non-exclusive license to use the images for personal use, which includes printing, sharing, and posting on social media, unless otherwise specified. Commercial use or modification of the images without the photographers written consent is prohibited.


5. Deliverables

Media by Mary will deliver agreed number of edited images (based on chosen session type) in digital format via online gallery within 30 days following the event. Client will have the right to request revisions to the edited images, after which additional fees may apply.


6. Model Release

Client grants photographer permission to use images taken during the event for promotional purposes, including but not limited to, advertising, portfolio use, and social media. If client does not wish to grant this permission, they must notify me in writing prior to the session.


7. Liability

The photographer will take reasonable care in providing the photography services but is not liable for any loss or damage to personal property or injury to persons during the event. Client agrees to hold photographer harmless for any accidents, injuries, or damage during or as a result of the event.


8. Duty of Client

Client will obtain all permissions necessary for Media by Mary to photograph at the shoot. Client understands and agrees that any failure to obtain permissions (of reception centers, churches, buildings, properties, or other locations) resulting in fines to photographer, or which prevent photographer from photographing the event(s) is not the fault, liability, or responsibility of photographer.


9. Indemnification

Both parties agree that photographer is under no obligation to capture any specific moment or pose of person(s) during photoshoot.


10. Force Majeure

Neither party shall be liable for any failure to perform their obligations due to unforeseen circumstances or events beyond their control, including but not limited to natural disasters, illness, or travel restrictions.

  • If photographer fails to perform her obligation if there is no unforeseen circumstances, client will receive a full refund of both initial deposit and final deposit.


11. Disclaimer

By signing this Agreement, the client acknowledges and agrees to the terms and conditions outlined above. Failure to agree to these terms may result in the inability to proceed with the photography services, in which case Media by Mary reserves the right to terminate the Agreement and withhold services, applying any applicable cancellation fees.


12. Behavioral Standards

The client and any guests should maintain respectful behavior during the event or photoshoot. Disruptive or inappropriate behavior, including but not limited to, verbal abuse, harassment, or aggressive conduct, may result in the immediate termination of the session. In such cases, no refund or compensation will be provided.


13. Children and Pets

If children or pets are part of the session, the client is responsible for their behavior and safety. Photographer is not liable for any injuries or accidents caused by children or pets during the session.


14. Entire Agreement

This agreement constitutes the entire understanding between the parties and supersedes all prior discussions, agreements, or understandings. Any modifications to this agreement must be made in writing and signed by both parties.


15. Signature

By signing below, both the client and the photographer acknowledge and agree to the terms outlined in this Agreement.

By signing this Photography Services Agreement, you acknowledge and agree to the terms and conditions outlined herein. Failure to agree to or comply with these terms may result in the inability to proceed with the agreed-upon photography services.

Each party agrees that electronic signatures have the same force and effect as manual signatures. Electronic signature means any electronic sound, symbol, or process attached with a record and executed and adopted by a party with the intent to sign such record.
